These terms and conditions outline the rules and regulations for the use of the Nelly & Woods Collective Stays website and for all bookings made directly through our website.

By accessing this website or making a booking with us, we assume you accept these terms and conditions. Do not continue to use the Nelly & Woods Collective Stays website or proceed with a booking if you do not agree to the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "Guest", "You" and "Your" refers to you, the person accessing this website and/or making a booking, and who is compliant with the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us" refers to Nelly & Woods Collective Stays. "Party", "Parties", or "Us" refers to both the Client and ourselves. "Property" or "Listing" refers to any accommodation offered by Nelly & Woods Collective Stays. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, the law.


1. Bookings and Reservations

1.1 Booking Confirmation

A booking is confirmed once you have received a booking confirmation from us and the initial deposit has been successfully processed. A confirmed booking constitutes a binding agreement between you and Nelly & Woods Collective Stays, subject to these terms and conditions.

1.2 Accuracy of Information

You are responsible for ensuring that all information provided at the time of booking is accurate and complete, including guest names, contact details, number of guests, and any special requirements. Please notify us as soon as possible if any details change.

1.3 Maximum Occupancy

Each property has a maximum guest occupancy as stated on the listing. You must not exceed this number without our prior written consent. We reserve the right to refuse entry or terminate a stay if the stated occupancy is exceeded.

1.4 Minimum Age

The primary guest making the booking must be at least 18 years of age.

2. Payment Terms

2.1 Deposit

A deposit of 20% of the total booking amount is required at the time of booking to secure your reservation. Your booking is not confirmed until this deposit has been successfully processed.

2.2 Remaining Balance

The remaining 80% of the total booking amount will be automatically charged to the payment method on file, 16 days prior to your scheduled check-in date.

2.3 Bookings Made Within 16 Days of Check-In

For bookings made fewer than 16 days before the check-in date, the full booking amount (100%) is required at the time of booking.

2.4 Payment Method

All payments are processed securely via Stripe. We accept major credit and debit cards. We do not accept cash, bank transfers, or cryptocurrency for direct bookings unless expressly agreed in writing.

2.5 Payment Failure

If we are unable to process the remaining balance on the scheduled date, we will contact you to arrange an alternative payment method. If payment cannot be resolved within two days, the booking will be treated as a cancellation in accordance with the cancellation policy below.

2.6 Currency

All prices are displayed and charged in Australian Dollars (AUD) unless otherwise stated.

3. Cancellation Policy

We understand that plans can change. Our cancellation policy is designed to be fair for both our guests and our small family-run business.

All cancellation requests must be made in writing by contacting us directly via email.

3.1 More Than 14 Days Before Check-In

You will receive a full refund of all amounts paid, including your deposit.

3.2 Between 7 and 14 Days Before Check-In

You will receive a refund of 50% of the total booking amount. Any amounts paid in excess of the retained 50% will be returned to your original payment method.

3.3 Less Than 7 Days Before Check-In

No refund will be issued. The full booking amount will be retained.

3.4 No-Shows

If you do not arrive on your scheduled check-in date and have not contacted us to cancel or modify your booking, this will be treated as a cancellation of less than 7 days. No refund will be issued.

3.5 Late Arrivals

If you plan to arrive later than your scheduled check-in date, please let us know in advance. We will hold your booking, but no refund or discount will be given for any nights not used.

4. Modifications to Your Booking

We will do our best to accommodate changes to your booking dates where availability allows. Please contact us as soon as possible if you need to adjust your stay.

  • Date changes are subject to availability and any difference in nightly rates for the new dates.
  • If a modification results in a lower total booking amount, any refund will be calculated in accordance with the cancellation policy above, based on the original check-in date.
  • If a modification results in a higher total booking amount, the additional amount will be charged to your payment method on file.
  • Modifications are not confirmed until you receive written confirmation from us.

5. Early Departure

If you choose to check out earlier than your scheduled departure date, no refund will be issued for unused nights.

6. Refund Processing

All refunds will be processed to your original payment method. Please allow 10 business days for the refund to appear on your statement, depending on your financial institution.

7. Travel Insurance

We strongly recommend purchasing comprehensive travel insurance to protect yourself against unexpected cancellations, travel disruptions, illness, or other unforeseen circumstances. Travel insurance may provide coverage in situations where our cancellation policy does not.

8. House Rules

Each property has specific house rules which will be provided to you prior to check-in. By confirming your booking, you agree to abide by these rules during your stay. Failure to comply with house rules may result in early termination of your stay without refund.

9. Pets

Some of our properties are pet-friendly. Where pets are permitted, this will be clearly stated on the listing. You must declare all pets at the time of booking. An additional pet fee applies. You are responsible for any damage caused by your pet(s) and for ensuring they are supervised at all times.

10. Check-In and Check-Out

Check-in and check-out times are stated on each listing. Early check ins and late check outs are only available if purchased in advance.

11. Third-Party Bookings

These terms and conditions apply to direct bookings made through the Nelly & Woods Collective Stays website. Bookings made through third-party platforms (such as Airbnb or Booking.com) are subject to that platform's own terms, cancellation policies, and payment processes.

12. Intellectual Property

Unless otherwise stated, Nelly & Woods Collective Stays and/or its licensors own the intellectual property rights for all material on this website. All intellectual property rights are reserved.

You may access this website for your own personal use, subject to the restrictions set out in these terms and conditions.

You must not:

  • Republish material from this website
  • Sell, rent, or sub-license material from this website
  • Reproduce, duplicate, or copy material from this website
  • Redistribute content from this website

Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. Nelly & Woods Collective Stays does not filter, edit, publish or review Comments prior to their presence on the website.

Comments do not reflect the views and opinions of Nelly & Woods Collective Stays,its agents and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. You hereby grant Nelly & Woods Collective Stays a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media. 

13. Hyperlinking to our Content

The following organizations may link to our Website without prior written approval:  

  • Government agencies; 
  • Search engines; 
  • News organizations; 
  • Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and 
  • System wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Website.  

These organizations may link to our home page, to publications or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site. 

We may consider and approve other link requests from the following types of organizations:  

  • commonly-known consumer and/or business information sources;

15. Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions. 

16. Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly. 

We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date. 

17. Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:  

  • limit or exclude our or your liability for death or personal injury; 
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation; 
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or 
  • exclude any of our or your liabilities that may not be excluded under applicable law.  

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty. 

As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
